Nuh Violence: Haryana police charge Congress MLA Mamman Khan with UAPA

The Haryana Police have filed charges under the Unlawful Activities Act (UAPA) against Congress MLA Mamman Khan in connection with the 2023 Nuh violence, which resulted in six fatalities.
In the final report released by the Nuh police, the legislator from Ferozpur Jhirka faces charges under sections 3, 10, and 11 of the anti-terror law, specifically for allegedly inciting violence, among other offenses.
Documents reveal that the Nuh Police took action nearly six months after communal clashes claimed six lives in Nuh and surrounding areas. The clashes erupted following a yatra organized by the Vishva Hindu Parishad (VHP) and the Bajrang Dal on July 31 of the previous year.
Earlier, the police had accused Khan of inciting violence and maintaining contact with suspects involved in sharing provocative content on social media. Additionally, he faces several other charges as outlined in the FIR.
Khan had been arrested last year in connection with the Nuh violence case, but he was subsequently granted bail by the court. Advocate Tahir Hussain Rupariya, who represents the accused, disclosed that he had requested a status report from the court. It was revealed in the report that the UAPA section has also been added to the FIR filed at Nagina police station.
During the ongoing Budget session in the Haryana Assembly, Congress MLA from Nuh, Aftab Ahmed, raised questions regarding the invocation of the Unlawful Activities (Prevention) Act (UAPA) in multiple cases registered at Nuh and Nagina police stations after the challan had been submitted in court.
Ahmed emphasized that the UAPA is typically invoked against terrorists, expressing concern over its application in cases involving Congress legislators. He highlighted a specific instance where a Congress MLA was charged under the UAPA, contrasting it with the absence of such charges in the Gurugram case where an Imam was killed in violence the previous year.
Earlier, the police had applied charges under the UAPA against suspects in three cases linked to the murder of two home guards and a Bajrang Dal member, as well as an attack on a cyber police station six months prior.
Although these charges were not initially included in the FIRs related to the cases, court documents revealed that they were added to the challan presented in court to contest the bail petition filed by the accused.
